iMap Policy

Effective August 1st, 2023, an Internet Minimum Advertised Price policy on the selected Ariston products will be in effect (herein referred to as “iMAP policy”)

As used in this iMAP policy, “reseller” means any reseller, distributor, sales representative, or dealer.

Ariston has decided to implement this unilateral iMAP policy to protect the value of our products and our reseller partner relationships. By not adhering to the established iMAP policy, a reseller can dramatically diminish or detract from the perceived value of the Ariston brands and products. This iMAP policy is intended to allow consumers to purchase from resellers based on loyalty and customer experience. In the interest of protecting both resellers and consumers, it is necessary to abide by the following requirements.

• The Minimum Advertised Price of Ariston products shall be no less than the price listed in this document. This Minimum Advertised Price is established by Ariston and may be adjusted at such time and in such amounts as it may determine at its sole discretion.
• Any Ariston product listings on third-party websites or your own website associated directly with your store(s) shall adhere to the Minimum Advertised Pricing.
• This iMAP policy applies to all advertisements of Ariston products in any and all internet media, including, but not limited to websites, social networks, banner ads, broadcast emails, landing pages, etc. This iMAP policy is not applicable to in-store advertising that is displayed only in the store and not distributed to any customers.
• If pricing is displayed anywhere other than a brick-and-mortar retail store, any strike-through or other alteration of the iMAP is prohibited.
• This iMAP policy does not establish maximum advertised prices. All resellers may advertise Ariston products at any price in excess of the Minimum Advertised Price.
• The iMAP policy does not, in any way, limit the ability of the reseller to advertise that “they have the lowest prices” or, they “will meet or beat any competitors’ price,” that consumers should “call for price” or phrases of similar meaning as long as the price advertised or listed for the product is not less than the Minimum Advertised Price.
• The iMAP Policy does not apply to the prices at which resellers actually sell covered products.  Resellers are free to sell those products at whatever price they choose, just as Ariston is free to choose in its sole discretion the resellers with whom it will conduct business. Ariston’s iMAP Policy is non-negotiable and strictly enforced.  This is a unilateral policy and not an agreement between Ariston and resellers of its products.
• Notwithstanding anything other provisions of this Policy, Ariston reserves the right to cancel any pending orders, restrict future orders, or suspend a reseller’s account if Ariston reasonably believes:
• A reseller has violated the provisions of the iMAP policy; or
• A reseller intends to violate the iMAP policy.
• Ariston’s iMAP Policy Administration is solely responsible for determining, in its sole discretion, whether a violation of the iMAP policy has occurred, as well as for determining appropriate consequences and sanctions.
• The iMAP policy will be enforced by Ariston in its sole discretion and without notice. Violations of the iMAP policy may result in sanctions up to and including termination of our business relationship, as well as any available remedies at law.

The iMAP policy has been established by Ariston to help preserve and protect the reputation of Ariston products. The iMAP policy is also designed to ensure that resellers have the incentive to invest resources into services for Ariston customers.

Minimum Advertised Pricing Policy Enforcement:

• On the reseller’s first violation Ariston may issue a notice of violation to the reseller by email. The reseller will then have twenty-four (24) hours from the date of the notice to acknowledge the violation and forty-eight (48) hours to correct and comply with this Policy. If the reseller does not correct the violation within that forty-eight (48) hour period, then Ariston, in its sole discretion, may cease to fill and accept orders from the reseller for the product model that is subject to the violation for a period of thirty (30) days.
• On the reseller’s second violation, Ariston will issue a notice of the violation by email to the reseller and, in Ariston’s sole discretion, may decide not to accept or fill any orders from reseller for a period of up to thirty (30) days from the date of the written notice of violation.
• On the reseller’s third violation within any 30-day period, Ariston will immediately and permanently place Reseller on a list of prohibited resellers and stop all sales to the reseller.
